Following Baldoni’s recent court win, Lively released a lengthy statement asserting she isn’t backing down, declaring she will continue “fighting to expose the systems and people who seek to harm, shame, silence, and retaliate against victims,” even including a dragon emoji to underscore her defiant stance.
Legal analysts, however, warn that such a combative tone could carry risks as the trial unfolds. If the case doesn’t turn out in her favor, Lively could face serious reputational damage.
Jordan Matthews of Holtz Matthews LLP told Fox News Digital that a verdict completely exonerating Baldoni could leave the “Gossip Girl” star vulnerable to public backlash, potentially casting her in the same light as other celebrities who faced high-profile courtroom losses.
The expert said, “It could essentially put her in the same category as Amber Heard, and she could be viewed as a pariah. If she and Baldoni both testify, then this will largely come down to witness credibility and how effective each of their legal teams are at cross-examination.”

A federal judge recently allowed Lively’s retaliation claims to proceed, highlighting allegations of a concerted effort by industry insiders to manipulate public opinion and undermine her reputation.
Crisis management expert Dave Quast advised that while a forceful approach may feel empowering, it can backfire.
He suggested that for the actress, a “calm, credible and unflinching” approach would better protect her brand, whereas appearing consumed by vengeance “risks damaging her brand.”
Entertainment attorney Tre Lovell emphasized the importance of the trial’s outcome for Lively’s public image.
He explained that a legal victory is critical to validating her claims and restoring her reputation. According to Lovell, “Her reputation has taken a very big hit, and she needs to resurrect her brand, the first step of which will be to win the case. As a result, aggressive litigation can only help her; now is not the time for her to take her foot off of the pedal.”

In a surprising turn of events, Judge Lewis J. Liman dismissed most of Lively’s claims against Baldoni, including allegations of sexual harassment and defamation, narrowing the lawsuit to focus primarily on her retaliation and breach-of-contract claims.
With Baldoni’s team already shaping public perception around the early rulings, some experts warn that a settlement at this stage could make Lively “look completely defeated.”
“The benefit of settling is that the parties basically control the outcome. The parties could reach a settlement, and they could both issue negotiated statements that help control the narrative,” Matthews told the news outlet. “However, even though Baldoni had many of the claims dismissed, they were largely dismissed based on technicalities, and not on the merits.”
Matthews added that Baldoni’s team has effectively framed the rulings to suggest he was fully cleared of sexual harassment allegations.
“If Lively settles now, then it will make her look weak,” he explained.
The Actress Pushes For Clarity On Justin Baldoni’s Testimony Ahead Of May 18 Trial

At the same time, Lively and her attorneys are pressing for clarity on whether Baldoni and his co-defendants will testify in person or via deposition.
In an April 7 letter to Judge Liman, they noted that Baldoni’s team, including Wayfarer Studios CEO Jamey Heath, co-founder Steve Sarowitz, PR specialist Melissa Nathan, and publicist Jennifer Abel, has yet to confirm how they will provide testimony.
Court filings obtained by USA Today suggest the defense is postponing this information to an unspecified future date, complicating Lively’s trial preparations.
The trial is set to begin May 18, and Lively’s team stressed that she must file a joint pretrial order by April 10, listing all witnesses and whether they will appear in person or by deposition.

Lively’s attorneys noted that attempts to obtain the information about how Baldoni and his co-defendants will testify from Baldoni’s side in “good faith” were unsuccessful.
According to the filing, Baldoni’s attorney, Ellyn Garofalo, said that, due to jurisdictional limitations, some witnesses may appear via deposition if they cannot attend in person.
Lively’s attorneys are now demanding a response by April 8 and request a “limited extension” to submit their own deposition proposals.
They argued, “The presence or absence of these parties at trial will substantially affect the presentation of evidence, including the order of witnesses, the parties’ preparation for testimony, and this court’s pretrial rulings.”
The attorneys added that withholding this basic information appears designed to give the defense a strategic advantage, potentially hindering Lively’s ability to properly prepare for trial.
