Now, questions are being raised about whether she would still be able to reflect on her life with Kelce in future music releases, particularly if the couple were to sign a prenuptial.

Legal expert Sarah Luetto has now weighed in on the conversation in a chat with Page Six.

Speaking with the outlet, the attorney claimed that a prenuptial NDA between Swift and Kelce would likely include “non-disparagement or non-disclosure terms related to their relationship.”

However, she believes Swift would ensure that any such agreement does not include provisions that restrict a key aspect of her songwriting style.

“In Taylor’s case, she would likely not want to include provisions limiting her from singing about her relationship in songs, particularly since there is always so much speculation about the subjects of her songwriting,” Luetto said.

For many celebrities, the possibility of their wealth being targeted by a scorned ex is often a lingering concern, something the legal expert said may also be addressed within the NDA.

According to Luetto, either member of the couple may choose to include provisions clarifying what constitutes community or marital property, in order to “avoid future claims to their creative work.”

“For example, if Taylor had re-recorded one of her albums during marriage, there would be an argument that the re-record was partially a marital asset,” the attorney told the outlet.

She also pointed out that the NDA may also include terms governing how dissolution could be done if the marriage doesn’t work out.

“They may include terms requiring mediation or, in states where permitted, the use of a private judge for any dissolution proceedings,” Luetto said. “For a high-profile couple like Swift and Kelce, privacy provisions of this nature would be particularly valuable in shielding the details of any potential dispute from public scrutiny.”

For fans of Swift and Kelce, it is no secret that the singer earns most of her income from music, while football remains the source of Kelce’s major earnings.

If and when the couple ties the knot, legal expert Luetto believes it is unlikely they would merge their estates in the traditional way some married couples do.

The attorney pointed to the “complexities” of their estates, including the lengths Swift has gone to in order to reclaim ownership of her masters and protect her music catalog.

However, she does believe the duo could combine assets for certain situations, such as when they choose to pursue a joint venture, and that this would not be overly complicated if they include a simple legal provision.

“They would simply need to clarify their ownership interests in any jointly held assets on a case-by-case basis,” Luetto shared.

Even without a combination of estates, Swift could still make significant financial contributions within the marriage.

Luetto noted that the singer is considerably wealthier than her fiancé, Kelce, and that prenuptial agreements include provisions where the higher-earning partner covers certain living expenses during the marriage.

“When one party is worth significantly more than the other, prenuptial agreements frequently provide that the wealthier party will pay all of the couple’s living expenses while the less wealthy party preserves their separate estate,” revealed the attorney.

Beyond potentially covering some of Kelce’s living expenses, Swift may also choose to share a portion of her estate, if she wishes to do so, as such arrangements are not uncommon in prenuptials.

“The amounts transmuted or gifted often increase over time, reflecting the duration of the marriage,” the lawyer added.

While neither Swift nor Kelce has made an official announcement about their wedding, multiple reports claim it will take place in early July in New York City.

The singer is said to be doing everything she can to keep details of her big day under wraps, with insiders telling TMZ that she has been personally calling her guests to alert them of her wedding instead of sending out the traditional “save the dates.”
