More than a year before KJ Biermann’s arrest put renewed focus on his cellphone, the device was already at the center of a highly sensitive dispute between his parents, Kim Zolciak and Kroy Biermann. 

Court records show the former couple battled over access to the phone after a discovery that remains hidden from public view. 

The disagreement quickly spilled into their divorce proceedings, triggering emergency filings, allegations about restricted access to the children, and a private judicial review that was later sealed from public scrutiny.

Kim Zolciak’s Divorce Filing Revealed A Hidden Discovery

Long before investigators allegedly uncovered disturbing material on KJ’s phone, court filings suggest concerns about the device had already emerged inside his parents’ divorce battle. 

Page Six reported that on February 18, 2025, Zolciak filed an emergency motion in Fulton County after what court records describe as a discovery made by Kroy.

The exact nature of that discovery remains unknown because key portions of the filing were redacted before becoming public. 

According to the motion, Kroy informed a court-appointed neutral mental health professional about the finding on February 7, 2025. 

Rather than identify the alleged material, Zolciak told the court, “In protecting the best interests of the children, Mother will not put into this public pleading what is alleged to be on REDACTED.”

At the same time, the television personality submitted a heavily redacted request for an in-camera inspection, a legal process that allows a judge to privately review evidence outside public view. 

Zolciak Claimed The Phone Changed Family Access

According to Kim Zolciak’s filing, the alleged discovery had immediate consequences inside the family. She claimed Kroy responded by taking control of the children’s phones and limiting communication between her and the children.

The motion alleged that Kroy “began battening down the hatches” after learning of the information. 

Zolciak further claimed he “unilaterally directed Mother that she would no longer have parenting time with any of the children, took possession of the children’s phones, and prohibited the children from communicating with Mother.”

The “RHOA” alum argued that the restrictions dramatically reduced her contact with them and raised concerns about both their welfare and the preservation of potential evidence.

“Mother has had extremely limited parenting time, and Mother has grave concerns for the children’s safety and wellbeing, as well as the preservation of evidence which may be (or may have been) stored REDACTED,” the filing stated.

Kim Zolciak’s Son’s Phone Was Later Sealed By The Court

As the dispute intensified, the cellphone itself became the focus of a formal court process. After the case moved from Fulton County to Cobb County, a February 21, 2025 filing referenced an order involving the inspection of the couple’s “eldest child’s cellular telephone, and the data thereon.”

The document specifically tied the device to the in-camera inspection motion filed days earlier, confirming that the phone had become a central issue in the divorce proceedings. 

Court records show the former spouses eventually agreed that their attorneys would seek an order governing how the device and any data stored on it would be handled and inspected.

That agreement did not bring clarity to the public record. The following month, a judge entered an order sealing documents connected to the matter. 

Since then, no publicly available filings have disclosed the outcome of the inspection, what information was reviewed, or what conclusions, if any, were reached.

Zolciak’s Son Arrested In Shocking Criminal Case

The mystery surrounding the cellphone began in August 2026, Kim Zolciak and Kroy’s 15-year-old son KJ was arrested in Georgia on charges including aggravated sodomy and aggravated sexual battery. 

According to The Blast, authorities alleged the case stemmed from an incident involving a female classmate at a Life Time Fitness location in Alpharetta. 

Court records showed KJ was later indicted on seven felony counts, including aggravated child molestation, aggravated sodomy, false imprisonment, and multiple counts of sexual battery involving a child under the age of 16. 

Prosecutors alleged the incident occurred on April 23, 2026, before they issued an arrest warrant months later. As the allegations became public, Zolciak forcefully defended her son. 

In a statement released to Page Six after the arrest, she called the accusations “nothing short of reckless and deeply troubling.” 

She added, “He categorically denies ever being involved with this woman or engaging in the conduct she has alleged.” Her camp also pointed to a voluntary polygraph examination and argued that investigators had not found DNA evidence linking KJ to the alleged victim. 

KJ’s attorney, Jason Sheffield, was equally adamant. “The fact that he’s been arrested and is being held without bond is a tragedy,” he told Page Six. “He is not only presumed innocent, but is, in fact, innocent.”

As Zolciak continued defending her son amid the growing legal battle, support came from a surprising corner of the “Real Housewives of Atlanta” universe. 

Despite years of public feuds and fallout, NeNe Leakes revealed she recently reached out to her former castmate following the headlines surrounding KJ Biermann’s case. 

Speaking about her decision to contact Zolciak, Leakes made it clear she was approaching the situation as a mother. Asked how Zolciak was handling the ordeal, she didn’t hesitate.

“As a mom, I’m just sure she’s not okay,” Leakes said per The Blast. 

Leakes explained that she had texted Zolciak within the previous few weeks as the reality star dealt with the public fallout from the allegations against her son. 

The former reality star also addressed the criticism Zolciak had received online since news of KJ’s indictment became public. Rather than join those questioning her parenting, Leakes refused to pile on.

“Everybody parents differently, so nothing,” she said when asked what she would say to critics blaming the reality star for the situation.
